A warning has been made from employment experts about the Illegal Migration Bill. It is believed that rogue employers will exploit migrants and asylum seekers if they don’t have the right to work.

The Illegal Migration Bill intends to make asylum requests prohibited for people who travel to the UK illegally. The law would detain and deport them to Rwanda or a “safe third country”.
Anyone who enters the UK illegally can also no longer access modern slavery support.

The government believe the bill will deter people from crossing the Channel in small boats or in the back of lorries.

    What have the employment rights professionals said?

    Employment rights professionals believe the bill will leave asylum seekers in limbo by confining them to temporary accommodation, where they cannot have their asylum claims heard and most will be unable to officially work.

    It could cause many asylum seekers to be exploited by rogue employers who offer them jobs only to exploit them without repercussions.

    However, because rogue employers know how to avoid detection, it will be hard to fully understand how the bill will affect asylum seekers.

    Employment rights professionals are interested to see if the Government will recognise this issue and handle it the same way they have applied the Illegal Migration Bill. Many believe the bill’s working restrictions are unpopular and unhelpful.

    Asylum seekers and work in the UK

    Asylum seekers often must wait months or even years before their asylum claim for refugee status is granted. This bill stops them from working even though last year 81% of the public said they support the right to work for people seeking asylum in the UK.

    The UK is also currently in a labour shortage. Employment law professionals believe refugees could support specific industries in this shortage.

    One professional said “Refugee Action research three years ago found that 74% of people seeking asylum had a secondary-level education or higher and more than a third held an undergraduate or postgraduate university degree. From a business perspective, these restrictive rules on them working make little sense given our acute labour shortages.”

    It is believed that the Shortage Occupation List should be updated to allow migrants to use a skilled work visa to fill work shortages.

    Professionals believe this will help businesses deal with labour shortages. It would mean a reduction in waiting time for asylum seekers to gain employment. This would be six months instead of 12. The Shortage Occupations List would also need to be updated every month.
